Terms of Service

Swimatics ("Swimatics," "we," "us," or "our") is a trade name (DBA) of Eryk Elizondo, a sole proprietorship operating in the State of Florida. These Terms of Service ("Terms") govern your access to and use of the Swimatics website, mobile app, and related services (collectively, the "Service").

By creating an account, subscribing to a plan, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.


1. Who Can Use Swimatics

You must be at least 18 years old to create a team ("Vault") and act as an owner, coach, admin, or office staff account. Parent/guardian accounts must also be 18 or older.

Athletes (swimmers) may register their own individual account only if they are at least 13 years old and have a birthdate on file confirming this. Swimatics does not knowingly collect personal information directly from children under 13. Information about swimmers under 13 is provided and managed exclusively by their parent or guardian through a parent account — the child does not create their own login.

By creating a team, you represent that you have the authority to agree to these Terms on behalf of your swim program.

2. Accounts and Vaults

A "Vault" is your team's private workspace within Swimatics — its roster, attendance records, schedules, and communications. Each Vault is created and owned by the person who completes payment setup for that team (the "Owner"). The Owner may invite coaches, office staff, parents, and athletes to join the Vault with varying levels of access.

You are responsible for maintaining the security of your account and for all activity that occurs under it. Notify us immediately if you suspect unauthorized access.

3. Plans, Billing, and Free Trials

Plans. Swimatics is offered in multiple subscription tiers (currently Individual, Bronze, Silver, and Gold), each with different features and staff limits, billed either monthly or annually. Current pricing is displayed at the time of signup and may change with notice.

Free trial. New subscriptions include a 7-day free trial. Your payment method is collected at signup but is not charged during the trial. If you do not cancel before the trial ends, your payment method will be automatically charged for the plan you selected, and billing will continue on a recurring basis (monthly or annually, as chosen) until canceled.

Cancellation. You may cancel at any time through your account's billing management page. Canceling — whether during your free trial or at any point afterward — immediately ends your access to all paid features of the Service.

Data retention after cancellation. Following cancellation, your team's data is retained for 7 days. If you do not resubscribe within that window, your team's data — including rosters, attendance records, messages, and all other associated data — is permanently and automatically deleted and cannot be recovered. If you resubscribe within the 7-day window, your data and access are restored. We do not currently offer a manual process to expedite or delay this deletion; it occurs automatically on this schedule.

Refunds. Except as required by law, payments are non-refundable, including for partial billing periods. You may cancel at any time to stop future charges.

Plan changes. You may upgrade or downgrade your plan at any time through your billing management page. Changes made mid-trial will end your trial immediately and begin billing right away for the newly selected plan.

5. Content and Data Ownership

You retain ownership of the data you input into your Vault — rosters, attendance records, messages, and similar content ("Team Data"). You grant Swimatics a limited license to store, process, and display this data solely for the purpose of operating the Service for you.

We do not sell your Team Data or your users' personal information to third parties.

6. Communications and Notifications

The Service may send messages, announcements, and push notifications between coaches, staff, and families as part of its core functionality. By using the Service, you consent to receiving these communications as part of normal use.

7. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or completely secure.

Swimatics is a scheduling, roster, and communication tool. It is not a substitute for direct communication regarding safety-critical or time-sensitive matters (such as practice cancellations due to severe weather); coaches and teams remain responsible for their own emergency communication procedures.

8. Limitation of Liability

To the fullest extent permitted by law, Swimatics and its owner shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of, or inability to use, the Service. Our total liability for any claim arising from these Terms or the Service is limited to the amount you paid us in the 12 months preceding the claim.

9. Termination

We may suspend or terminate your access to the Service if you violate these Terms. You may stop using the Service and cancel your subscription at any time as described in Section 3.

10. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will provide notice (such as an in-app notice or email) before the changes take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Florida.
